A private bailiff refused to initiate enforcement proceedings against the Bank. The bank appealed the actions of the CSI in court (6001-22-00-6ap/221).

The local courts denied the Bank’s claim. The motive of the courts is that the debtor who has assumed the obligation to repay the debt is a legal entity, but not an individual.

However, the Bank, ignoring the judicial acts that had entered into force, filed a claim and insisted that the debtor in the enforcement proceedings was an individual.

The Judicial Collegium for Administrative Cases of the Supreme Court upheld the judicial acts handed down in the case.

In addition, the Bank was fined for dishonest behavior, namely the presentation of a knowingly unfounded claim and cassation appeal, as well as ignoring the conclusions of the judicial acts.
